Notice is hereby given that the Emmitsburg Board of Appeals will hold a public hearing at 7:00 p.m. on Tuesday March 19, 2024, at the Town Office located at 300A South Seton Avenue, Emmitsburg, MD 21727.  The applicant, on behalf of the owner of the property at 17750 Creamery Rd. (Zoning District: Industrial Park), is seeking a special exception under §17.24. The purpose of this is to allow an insurance agency occupy unit 2A North of the building.

Planning Commission

The Town is seeking an individual to serve as an alternate on the Planning Commission!
The Planning Commission serves as a decision-making body and as an advisory board for the Mayor & Board of Commissioners.  The alternate member will serve when a regular member is absent or otherwise unable to attend. In such cases, the alternate member will make decisions on a variety of applications that typically involves subdivisions (preliminary & final plats), forest stand delineation plans, forest conservation plans, improvement plats, site plans, zoning map and text amendments, and comprehensive plan updates. 

  • All members of the Planning Commission must reside within the Town limits
  • Members are appointed by the Mayor with consent of the Commissioners
  • Term lasts for 5 years.
  • Most meetings are held on the last Monday of the month.

Low Income Household Water Assistance Program in Maryland

The Low-Income Household Water Assistance Program (LIHWAP) will be ending soon, and the Office of Homer Energy Programs (OHEP) has various phases to sunsetting the LIHWAP program.  OHEP wanted to provide all of our water partners with important dates and a brief overview of what happens on those dates that will officially closeout LIHWAP on June 30, 2024.  
March 1, 2024 - Last day for customers to submit a LIHWAP application to their local office or online.
March 31, 2024 - Last day for cases to be processed and approved by the local OHEP offices.
May 1, 2024 - Any remaining LIHWAP funds will start being distributed evenly among all LIHWAP recipients to their water supplier.
June 15, 2024 - Last day for an OHEP office to send out a LIHWAP payment to a water vendor on behalf of a customer.
June 30, 2024 - LIHWAP officially ends. 

As mentioned in the timeline, OHEP will be providing a supplemental payment to all LIHWAP customers on May 1, 2024 with any remaining funds. The supplemental payment is a flat payment that divides any remaining LIHWAP funds evenly among all LIHWAP recipients.

Farmland Raptors Program

The Farmland Raptor Program sponsored by the Maryland Bird Conservation Partnership (MBCP) is working with the Frederick Bird Club (FBC) to significantly increase nesting sites for Barn Owls (Tyto alba) and American Kestrels (Falco sparverius) throughout Frederick County. We are offering to build, install, and monitor nest boxes for Barn Owls and American Kestrels – all at no-cost to local organizations, farmers, and property owners. Both species of raptors prefer open or semi-open habitats especially farmland, cultivated fields, fallow fields, and grassland areas.

Emmitsburg Rain

On Tuesday January 9th our area received just shy of 4 inches of rain in a twelve-hour period. To say the least this amount of precipitation puts a stress on our stormwater and sewer system. The sewer lift station on Creamery Rd was pumping at full capacity at 3500 gallons per minute. Unfortunately, the pumping station was still overwhelmed which caused spillage from manholes on the east side of town. Our staff worked during the storm to keep all equipment running at full capacity, and as the water receded, operations went back to normal.

The effected areas have been a problem for many years, but steps are being taken to address the issues. The town has installed new monitoring hardware in the sewer system to track higher than normal water flows during heavy rain events. We are currently relining existing sewer lines to prevent the influx of storm water. Lastly, we have found sewer cleanouts that have cracked or broken caps that allow rainwater to enter the sewer system. While these may seem like small initiatives, this has reduced the flow of wild water into the sewer system significantly.

Since the sewer system was over its rated capacity flow, we had to report this incident to the Maryland Department of Environment and Frederick County which was completed first thing this morning.

Sustainable Communities Work Group

The Town is seeking two (2) individuals to serve on the Sustainable Communities Workgroup (SCWG). The Town relies on this workgroup to provide well-considered recommendations for renewal efforts that align with the community’s development priorities. The workgroup also serves as the community's reviewing body for the Community Legacy Facade and Restoration Grants, offering suggestions on applications to be forwarded to the Maryland Historical Trust. Impending Snow Storm

Impending snowstorm January 6, 2024. All vehicles must be off any public road in the Town limits once the snow emergency plan is enacted. Please plan ahead. However, if you need assistance, please call 301-600-6300. If you need a place to park, you are able to park at these locations, Community Park, Memorial Park, Pool Parking lot and the Town Office parking lot.

Message from the Mayor

 Message from the Mayor
As you are aware we received much-needed rain over the weekend to replenish our water supply on the mountain. Unfortunately, sometimes good things come too fast and that was the case with Sunday’s storms.
When we get several inches of rain in a short period of time this causes the sediment in Rainbow Lake to get stirred up.  The water plant filters must work harder to filtrate the incoming water from the lake, and this takes several days to return to normal operations. We are headed in that direction. We anticipate lifting the Water Ban on Friday December 22, 2023.
Unfortunately, The Maryland Department of Environment received a single anonymous complaint pertaining to our water quality. This complaint was investigated and closed. Our water quality is exceptional, and our trained staff is taking the necessary step to return operations to normal.
I hope everyone enjoys the upcoming holidays and I look forward to continuing to work for you in the new year.

December 12, 2023 Special Meeting

The Board of Commissioners will be meeting on December 12th at 7pm in open session for the purpose of voting to go into a closed executive session for the hiring of two candidates.  The authority for meeting in closed session for this purposed is permitted by the General Provisions Article, Section 3-305(1), Annotated Code of Maryland which authorizes us to meet in closed session to discuss employment. For this reason, the open meeting will not be televised however you may attend in person up through public comment.

Parking Meters

The Mayor and Board of Commissioners are considering adding an additional 16 new smart meters that will accept coin, credit card, and mobile payment on West Main Street between 400 - 521 W Main St at their January 8th town meeting. This is being proposed in conjunction with replacing all current meters in Town with smart meters and adding 3 multi-space meters at the pool parking lot for use before and after the pool season (Memorial Day to Labor Day). Turkey Trot 2023

2023 Emmitsburg Turkey Trot was a HUGE success!!!!!
We want to thank everyone who participated in this event. Without you, the event would not have been such a great turnout! 
We would also like to thank everyone that volunteered their time to help on Thanksgiving. Without each of you, we wouldn't have been able to pull off a great event. We didn't expect to have such a big turnout and we apologize for not being able to get everyone their t-shirt, medal or swag bag. 
Great news is.........Your items are coming. 
Commissioner O’Donnell will be handing out the swag bags, medals, and t shirts that participants are owed from participating in the Turkey Trot this year. He’s hosting 2 nights of distribution, Thursday December 14th from 6:45pm to 8 pm, and Thursday January 18th from 6:45pm to 8pm. Both days will take place in the meeting room at the Emmitsburg Library. 
Thank you again for such a great event! We look forward to next year!

Sewage Procurement

The Mayor and Town Manager authorized Synagro to pump out the wet well at the pump station, haul away sewage, provide labor and provide a backup pump until repairs can be made to our pump.  On November 21st and 22nd the Town received a significant amount of rain in a short period of time.   Unfortunately, the pump station experienced a pump failure causing the pump station to flood.  Due to this, MH#98 in Emmit Gardens overflowed causing sewage to leak into the land and nearby creek.  As a result, this created a need for emergency procurement in an effort to protect the health and safety of our residents as well as the protection of property.  As permitted by Town Code, 3.12.090 staff requested assistance from a contractor with expertise as well as equipment in this area.

Standby rate for the back-up pump is $1,575 per day.  As of day, the pump has been on site six days.  The pump will remain until repairs are made to our back-up pump.

Pump Station Issue

Due to the amount of rain that we received on 11/21/23 and 11/22/23, our pump station suffered a disastrous failure causing the pump station to flood. As a result, a large sanitary overflow occurred at Emmit Gardens. Per MDE, the property has been posted for 1 month as contaminated.

The location of this manhole is in an empty field.

MDE and Frederick County Health Department have been notified.

Dog Waste Cleanup

Just a friendly reminder to clean up after your dog. There are dog waste stations located in the parks and on East Lincoln. Here is the Town code
6.08.020 - Animal waste.
A. Disposal Required. An owner or other person who has possession or control of a dog or other animal: 1.May not permit the animal feces to remain upon any park, sidewalk, or other public property; and 2.Shall properly dispose of the animal's feces. For the purpose of this section, "properly dispose" means to place in a designated waste receptacle or other refuse container that is regularly emptied by the town or some other refuse collector; or to dispose into a system designed to convey domestic sewage for proper treatment and disposal.
B. Violation. Violation of this section is a municipal infraction punishable by a fine of one hundred dollars ($100.00) for a first offense, two hundred dollars ($200.00) for a second offense, and three hundred dollars ($300.00) for a third or subsequent offense per calendar year.

Phase 2 Mandatory Water restrictions

Mayor Davis, after consultation with the Commissioners and Public Works staff, has enacted Phase 2 Mandatory Water restrictions due to the lake and well levels.  This means there are restrictions on outdoor water consumption including filling of swimming pools and washing of anything outdoors including vehicles, houses, sidewalks, etc.  This also includes the watering of lawns, gardens or shrubs.

It will be “to discuss the appointment, employment, assignment, promotion, discipline, demotion, compensation, removal, resignation, or performance evaluation of appointees, employees, or officials over whom this public body has jurisdiction; any other personnel matter that affects one or more specific individuals”

Final Notice and Public Explanation of a Proposed Activity in a 100-Year Floodplain
To all interested agencies, groups and persons:
This is to give notice that the Town of Emmitsburg under Part 58 has conducted an evaluation as required by Executive Order 11990, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and Wetlands Protection.  The activity is funded under the Maryland Community Development Block Grant program under grant number MD-24-CD-22. The proposed project is located along DePaul Street in Emmitsburg, Maryland in Frederick County. The project would involve the replacement of an existing 1,850 linear feet unlined cast iron waterline along DePaul Street with a new ductile iron waterline. The purpose of this project is to address the need for improved infrastructure to provide essential public water services to low-and-moderate-income persons. The total number of floodplain acres involved is 0.54 acres.

 The Town has considered the following alternatives and mitigation measures to be taken to minimize adverse impacts and to restore and preserve natural and beneficial values:

  1. Locate the project within the floodplain at the proposed site. This project is an infrastructure improvement project. The project site is a HUD low-and-moderate-income area. The proposed project will provide improved public water services for the DePaul Street residents.
  2. Locate project at another site in Town. Alternative locations cannot be considered because the DePaul Street waterline needs to be replaced. Other locations would not meet the HUD low-and-moderate-income benefit area requirements.
  3. Modify the project area to exclude the floodplain. This alternative would modify the project scope to exclude work in the floodplain. This alternative is rejected because it would result in at least five low-and-moderate-income households losing existing public water service.
  4. No action alternative. Not pursuing this project increases the likelihood of the waterline failing due to age. The waterline needs to be replaced to continue to provide water to low-and-moderate-income persons.

 All appropriate design standards have been met for the construction that is to take place in the floodplain.  The project will comply with all state and local floodplain protection procedures.

The Town has reevaluated the alternatives to building in the floodplain and has determined that it has no practicable alternative.  Environmental files that document compliance with steps 3 through 6 of Executive Order 11990, are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments.

There are three primary purposes for this notice.  First, people who may be affected by activities in floodplains and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas.  Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplains can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains, it must inform those who may be put at greater or continued risk.

Written comments must be received by the Town at the following address on or before October 21, 2023: Town of Emmitsburg, 300A South Seton Avenue, Emmitsburg, Maryland 21727 and (301) 600-6300, Attention: Madeline Shaw, Grants Administrator. A full description of the project may also be reviewed between 8:00 a.m. and 4:30 p.m. Monday through Friday at the same address. Comments may also be submitted via email at Mshaw@emmitsburgmd.gov.

Chili Cook-Off Cancelled

Update: The Chili Cook-off has been cancelled.
We were so happy with all of the excitement around the chili cook-off but unfortunately, we didn't get enough donations or people who wanted to participate. The health department doesn't have enough time to process the applications even if we received more by the end of the day.
We do apologize but we will try this again next year. Thank you to everyone who shared, donated and to the people that were registered to cook.

Citizen's Advisory Committee

The Town of Emmitsburg is looking for interested persons to serve on the Citizen’s Advisory Committee. 

  • A Citizen Advisory Committee is a citizen volunteer group and the purpose of this committee is to reach and propose general recommendations, rules and policies related to quality of life issues in the Town of Emmitsburg. For more information please visit our website at www.emmitsburgmd.gov

  • Committee members must reside in the Town of Emmitsburg as 1 member may reside outside Town limits.

County Executive to Host Hybrid Event for Public Input

 FREDERICK, Md. – Frederick County Executive Jessica Fitzwater invites the public to her annual Legislative Town Hall. This town hall is an opportunity for members of the public to suggest or comment on the County's legislative priorities for the upcoming session of the Maryland General Assembly. Executive Fitzwater’s priority legislation this year focuses on historic preservation, safety standards, and transportation. The Town Hall will be held at Winchester Hall on Thursday, October 5, beginning at 6 p.m., with a virtual participation option available.
“A people-centered government relies heavily on the input of the residents we serve,” Executive Fitzwater said. “We have an opportunity to advocate for the growing needs of our community by ensuring everyone’s voice can be heard as we present our legislative package.” 
The public is invited to comment on any of the proposals, or suggest additional topics for consideration. The meeting will be televised live on FCG TV, cable channels 19/1085, and webcast at FrederickCountyMD.gov/LegislativeTownHall. Executive Fitzwater’s priority bills include Historic Preservation Tax Credit Reform, Corrugated Stainless Steel Tubing Standards, and a Paratransit Funding Task Force. Frederick County’s Historic Preservation Tax Credit Program was established in state code. This bill would strike the existing program from state code so the County Executive and Council can consider legislation to establish an updated program in County Code. The revised program would expand eligibility of the historic preservation tax credit to more properties by basing the credit on the Qualified Rehabilitation Expenses, rather than a change in assessed value.

Improving safety standards remains a priority, especially as it pertains to standards that impact firefighters and residents. Corrugated Stainless Steel Tubing (CSST), a tool used in homes across the country to deliver propane and natural gas, has been connected to several lethal fires, including a 2021 house fire that resulted in the line-of-duty death of Battalion Chief Josh Laird. CSST is vulnerable to mechanical and electrical failure that can result in gas leaks or fire. This bill would require CSST used in Maryland to meet the specific safety and performance standards and build on the work of HB1052, passed in 2022, which prohibited the use of non-arc resistant CSST in new construction or renovations.

Understanding the importance of transportation options for older adults and individuals with disabilities is also a priority. Paratransit is a door-to-door demand-response service for people who are unable to use public transit to get to medical appointments. In Maryland, the State offers a small amount of funding via the Specialized Statewide Transportation Assistance Program. Funding for this program has been flat for 16 years, preventing counties from keeping pace with this growing population. This bill would establish a task force to study the growing need for paratransit and make recommendations.

Water Supply - MDE

Please read below. We just received this message and wanted to pass along to all water users.
 
Dear Water Supplier:
 
Earlier today, MDE released an official declaration of a drought warning for central Maryland. The affected counties are Baltimore, Carroll, Cecil, Frederick, Harford, Howard, and Montgomery Counties, except those areas served by the Baltimore City or WSSC public water systems. Western Maryland is still in a drought watch (Allegany, Garrett, and Washington counties).
 
MDE is encouraging all Marylanders throughout the state to take voluntary steps to reduce their water use by 10%-15%. We are requesting that public water systems take steps to reduce water usage by increasing public awareness, contacting individual industrial users to reduce water usage, and discontinuing flushing water lines.
 
Our website has tips for water conservation for the general public, and for specialized users such as restaurants and commercial buildings.
 
We are moving to weekly drought monitoring at this time. Please check the MDE drought landing page for the most up to date monitoring report.

September Is National Preparedness Month

FREDERICK, Md.The month of September is National Preparedness Month, an awareness campaign designed to encourage people to prepare for disasters and emergencies. This year’s theme, designated by the Federal Emergency Management Agency, is “Preparing for Older Adults.”
During September, Frederick County Division of Emergency Management will join a nationwide effort to share preparedness information with a special focus on older adults. Older adults can face greater risks when it comes to extreme weather events and emergencies, especially if they are living alone, are low-income, have a disability, or live in rural areas. 
"Older adults should plan in advance for disaster by creating a communications plan and support network, planning for assistance medical devices, and having copies of insurance cards and extra medicines in your emergency kits." said Anthony Rosano, Deputy Director of Emergency Management.
While this year’s focus is older adults, everyone can do their part to keep the community safe by preparing for emergencies. Take action by reviewing your family emergency plans, updating disaster supply kits, checking insurance coverage, and knowing where to find local emergency information.

Just wanted to take a moment to share what your water increase for average residential user may look like with the upcoming September quarterly bill.

Rate increase for 6,000 gallons:

$35.00 to $47.60 per quarter (on average there are 91 days in a quarter).  This is equal to paying 52 cents per day for water.

This increase is equivalent of $12.60 per quarter or $50.40 a year.

This breaks down to $4.20 per month increase or 14 cents a day.

Rate increase for 8,000 gallons:

$39.80 to $54.12 per quarter.  This is equal to paying 59 cents per day for water.

This increase is equivalent of $14.32 per quarter or $57.28 a year.

This breaks down to $4.77 per month increase or 16 cents a day.

Rate increase for 12,000 gallons:

$53.60 to $75.32 per quarter.  This is equal to paying 83 cents per day.

This increase is equivalent to $21.72 per quarter or $86.88 per year.

This breaks down to $7.24 per month increase or 24 cents a day.

Phase 1 Water Restriction

ALERT:
Due to the lack of rain the Maryland Department of Environment released an official declaration of a drought watch for central and western Maryland which includes Emmitsburg.  MDE is encouraging all Marylanders throughout the state to take voluntary steps to reduce their water use.  Mayor Briggs, after consulting with staff and Commissioners, has ordered Phase 1 water restrictions as permitted by the Emmitsburg Town Code. Phase 1 water restrictions entail voluntary conservation restraints by all users of water from the municipal water system of the Town.

Paving Project Emmitsburg

Emmitsburg paving project set for weekend

A paving project will cause lane closures for about two miles of Main Street in Emmitsburg on Saturday and Sunday, according to the State Highway Administration.

The patching and microsurfacing project between Warthens Court and the Pennsylvania border will lead to single-lane closures with a flagging operation from 8 a.m. to 4 p.m. Saturday and Sunday, according to the SHA.

Microsurfacing is a road treatment that improves ride quality and increases friction to reduce the chance of skidding during inclement weather.

The contractor, Slurry Pavers, of Richmond, Va., will use barrels, cones, flaggers and electronic boards to guide drivers through the work area

Road Work


The Town was just notified this morning that SHA approved work to be completed on MD 140 from Warthens Court to Pennsyvania State line for a Microsurfacing treatment operation that is a thin lift of asphalt for the roadway. The hours of operation are Monday through Friday from 7am to 5pm. This is a State Highway project, if you have any problems, please contact State Highway. Thank you.

DePaul Street Waterline

Attention DePaul Street residents

As a Town, I know there have been some concerns with the upcoming water increase. We want to show you an example of a current bill and what it will look like when the increase happens in July. This example is for a family of six that uses 20,000 gallons of water every quarter.
Item #1 – Copy of actual current water, sewer and trash bill for a family of six using @ 20,000 gallons per quarter.
Item #2 – What the bill will look like (minus trash, maintenance, and bay restoration) after the July 1st increase. You will see this increase on your September 30th water, sewer and trash bill.
We hope this helps with what the increase will look like. This is a high user, so if you use under that amount, your bill will not look like this.

The Town of Emmitsburg is requesting sealed bids from qualified engineers in order to create an engineered design and improvement plan of the Town’s North Seton Avenue Green Infrastructure Project. Street repair after waterline replacement will occur in conjunction with a Green Street enhancement that will feature stormwater infrastructure such as permeable concrete, bio filters for stormwater runoff, bioretention planters, new sidewalks, new crosswalks, native planting areas and green drainage inlets, etc.

Four copies of the sealed proposals are due by 4:00 pm on Friday, May 12, 2023. Proposals will not be accepted via email. Please boldly note on the sealed bids “North Seton Avenue Project, Do Not Open.” Please direct any questions to Madeline Shaw, Grants Administrator, at Mshaw@emmitsburgmd.gov or (240-741-2137). Hydrant Flushing Week of April 17-21

Reminder.........Hydrant flushing maintenance will happen the week of April 17 - April 21.
This is good for Emmitsburg for the following reasons.
- verifies proper operation of the hydrant
- evaluates the available flow to the hydrant
- allows utilities to deliver the highest quality water possible to their customers
- removes mineral and sediment build up from the water mains
During hydrant flushing, it is possible to experience a temporary drop in water pressure or discolored water.
Water can become discolored after flushing and may linger for a few hours. It is not harmful to drink. If this happens, run your cold water tap for a few minutes until the water is clear. If it is not clear the after the first try, wait a few minutes and repeat this process.

Trash Collection Reminder

As trash collection day came to an end, it’s a good time to remind ourselves of the town’s policy on trash collection. Please remove your trash cans from the edge of the street/curb line within 12 hours of pick up. As the week goes, please keep all can’s covered, and all bags tied tight. Finally for next week’s collection please place your trash outside no earlier than 6pm the day before collection. All of our effort to adhere to the code will help ensure that Emmitsburg remains clean and beautiful for all her citizens. Thank you

Trash Can Issues

It’s come to our attention, people aren’t being mindful of their trash. As a reminder please only place your trash out between 6pm the night before collection and 6am the day of collection. Once your trash is collected promptly (within 12 hours) remove your garbage cans from the curb line or edge of the street. It seems minor but our collective effort to adhere to the standard set in the town code will help us have beautiful clean and easy to navigate streets. Thank you!

The Board approved changing the Farmers Markets hours next year to 2pm-8pm on Fridays.     
They are continuing to look for ways to improve our Farmers Market. 

Free Metered Holiday Parking


The Board at the Mayor's direction approved Free Metered Holiday Parking from Friday, December 9th through Tuesday, January 3rd.
Any monies collected will be donated to the Lions Club for Heritage Day Fireworks, the Friends of the Emmitsburg Library and the
Seton Center.

Board of Commissioners Meeting


Due to technical difficulties caused by a hacker, the November 7th town meeting did not record in its’ entirety.  Below is a summary of action taken during this meeting:

  1. The Commissioners unanimously approved the Proclamation for Municipal Government Works Month November 2022.
  2. The Commissioners unanimously approved the following:
    1. Resignation of Dan Garnitz from Board of Appeals.
    2. Appointed Dan Garnitz to the Planning Commission.
    3. Appoint Jack Pollitt as an alternate to the Board of Appeals.
  3. The Commissioners, after hearing testimony from staff, planning consultant, town attorney, the applicant and his attorney as well as public comment voted 4-0 with one abstention to deny Ordinance 2022-10 which would have allowed private shooting ranges in the Town of Emmitsburg.
  4. The Commissioners voted 4-0 with one abstention to deny Ordinance 2022-11 which would have allowed the use of firearms at private shooting ranges in the Town of Emmitsburg.
  5. The Commissioners continued discussions on increasing water and sewer rates.  The Commissioners will hold a public hearing on the proposed increases at the December 6th town meeting.  For consideration will be a three-year staggered increase on the water rates and a 3% increase on sewer rates.
  6. The Commissioners unanimously approved Policy P22-01 which allows small game hunting in the watershed at the same time as deer and turkey.
  7. The Commissioner unanimously approved Resolution 2022-05r which formally adopts the Frederick County Hazard Mitigation Plan.
  8. The Commissioners approved 4-1 to revoke the whole Rutters’ Forest Conservation easement and send it back to the Planning Commission for its decision and determination.
  9. The Commissioners unanimously approved town staff to prepare a text amendment to allow for fences greater than four feet tall in the front yard of corner and thru lots.  This text amendment will go to Planning Commission for review.

Phase 1 has been implemented


Rainbow Lake is currently 2 feet below the spillway level at 14.6’.  Therefore, as permitted by Town Code, Phase 1 has been implemented. 
This is a voluntary conservation restraint by all users of water from the municipal water system of the town.

Historic Wayside Exhibit - St. Joseph's Academy

On Thursday, October 6th Mayor Briggs attended a ribbon cutting ceremony for the St. Joseph Academy Wayside Exhibit that was installed in front of the National Emergency Training Center Campus. The exhibit is the 14th and final wayside exhibit the Town has installed as part of a future historic walking tour to help draw tourism to the area and celebrate Emmitsburg’s history.

Hydrant Flushing FAQ:

1. Why does the Town perform hydrant flushing?

Hydrant flushing is the quick release of water from fire hydrants. It’s a controlled procedure that is vital to the general maintenance of the Town’s water distribution system. It ensures adequate water flow is available to fire fighters, residents and businesses. It also improves water quality by clearing iron and other mineral deposits from the water mains.

2. What are the effects of hydrant flushing?

Hydrant flushing helps ensure water quality and helps avoid random bouts of rusty water if there is a high demand for water, caused by a major firefighting effort or water main break.
During the flushing of a hydrant, some customers may notice reduced water pressure and flow.

3. Why is my water rust/tea-colored from the hydrant flushing? Is the water safe?

Sometimes hydrant flushing can make the water temporarily appear rust-colored because the iron and other mineral deposits in the water mains get stirred up. There is no health hazard associated with discolored water. Water is safe to use and consume during hydrant flushing, however it may stain laundry.

Thanks to all who came out to celebrate the 100th anniversary of Emmitsburg Community and Emmitsburg High school building’s wayside sign and history. Special thanks to librarian Penny Stockton for creating a new exhibit for the building, the Town of Emmitsburg for the new wayside sign, Mayor Don Briggs, Commissioner Joe Ritz, Commissioner Frank Davis, Commissioner Tim O’Donnell,  County Executive Jan H. Gardiner, and Mother Seton School VMY students for volunteering. Also want to give thanks to Joyce Bruchey from the Emmitsburg High School Alumini. She has provided all the research for the Wayside signs since spending years on gathering valuable information.

Stormwater Management Utility Fee Enacted

Stormwater Management Utility Fee Enacted

At their meeting on September 12, 2022, the Mayor and Board of Commissioners enacted a $20.00 per Equivalent Residential Unit (ERU) fee on all real property in the Town, which includes real property that is tax exempt.  An ERU is the standard unit of measure to equate non-residential or multi-family residential properties to the average impervious surface area of a single family residential property in the Town.  One ERU equals 2,932 square feet of impervious surface area.  Each property’s fee will be strictly dependent on the amount of impervious surface.  The fee will be as follows:

Residential:

  • 20% of the properties (173 parcels) will be charge ½  ERU = $10.00 per year or $2.50 per quarter.  These are properties with less than or equal to 1,466 square feet of impervious surface.
  • 69% of the properties (616 parcels) will be charged 1 ERU = $20.00 per year, or $5.00 per quarter.  These are properties with greater than 1,466 and less than or equal to 4,398 square feet of impervious surface.
  • 11% of the properties (96 parcels) will be charged more than 1 ERU.  These are properties with greater than 4,398 square feet of impervious surface.

Non-residential:

  • 16% of the properties (11 parcels) will be charge ½  ERU = $10.00 per year, or $2.50 per quarter.  These are properties with less than or equal to 1,466 square feet of impervious surface.
  • 12% of the properties (8 parcels) will be charged 1 ERU = $20.00 per year, or $5.00 per quarter.  These are properties with greater than 1,466 and less than or equal to 4,398 square feet of impervious surface.
  • 72% of the properties (49 parcels) will be charged more than 1 ERU.  These are properties with greater than 4,398 square feet of impervious surface.

Fees collected will be deposited into the newly created Stormwater Management Enterprise Fund, which will be used only to fund stormwater management, storm drainage, and water resources programs and services required by the Town’s mandatory National Pollutant Discharge Elimination System General Permit for Discharges from Small Municipal Separate Storm Sewer Systems (MS4).  This permit is an unfunded federal and state mandate.  Fees will be added to quarterly sewer, water, and trash bills starting in January 2023, and it is expected to generate approximately $34,500.00 per year.  

Within 30 days after the date of the initial bill assessing the stormwater management utility fee to the property owner, the owner may request an adjustment of the stormwater management utility fee.  A request for an adjustment must be submitted to the Town Planner in writing, stating the grounds for the request.  The Town Planner may adjust the utility fee if:

  1. The impervious surface area was measured incorrectly;
  2. There is a mathematical error in calculating the stormwater management utility fee;
  3. A credit was not properly applied (non-residential properties only); or
  4. The property owner invoiced for the fee was identified in error.

Absentee Ballot Requests Are Due Today

Absentee Ballot Requests must be turned in to the Town Clerk by close of business on Tuesday September 13, 2022.  You must be registered to vote to obtain an absentee ballot. Absentee ballot voting is available for any qualified voter who is unable to cast a ballot during regularly scheduled election day hours due to (1) vacation and/or business travel outside of Town; (2) a physical condition, illness, injury, disability, or other medical condition or health related circumstance that creates a risk of substantial harm; (3) military service; (4) attendance of school outside of Frederick County; or (5) employment and/or commute during polling hours.

Reservation requests for the upcoming autumn gymnasium at the Emmitsburg Community Center are now being accepted. Please email your request to sking@emmitsburgmd.gov or drop off at the Town Office.  With your reservation request, please:

  1. Be sure to specify what sport/activity will be performed at the gym.
  2. Be sure to specify the name of group and contact information for responsible party.
  3. 501(c) 3 documentation must be submitted with your request (if applicable).

The Town Office Will Be Closed For Labor Day

Town offices will be closed on Friday, Sept. 2nd from 2:30pm to Monday, Sept. 5th, 2022. We will be back in the office on Tuesday, Sept. 6th, 2022.

Reconstruction of the Silo Hill Stormwater Management Pond

Reconstruction of the Silo Hill stormwater management pond will start in late September.  With this project, we will:
    • Implement water quality controls capable of treating 7.96 acres of impervious area to address nutrient loading into the nearby Upper Monocacy River (with eventual drainage into the Chesapeake Bay).  The proposed improvements will remove 57.94 lbs/year of nitrogen, 9.47 lbs/yr of phosphorus, and 14.51 tons/yr of total suspended solids. 
    • Increase water quantity controls in anticipation of increased storm frequencies and intensities without increasing discharge flows.
    • Create an aquatic and wetland fringe habitat within the existing footprint of the dry extended detention pond.
    • Improve the biodiversity of the stormwater management feature through comprehensive planting and maintenance plans. 

This project is necessary in order for the Town to meet its mandatory requirements under the federal Clean Water Act to improve water quality in Maryland’s streams, rivers, and the Chesapeake Bay.

Water Usage Reminder

The watering of lawns, shrubs, flowers, gardens, etc. via the public water system is prohibited everyday between the hours of 9:00 am and 6:00 pm (Per Town Code 13.04.170). Anyone violating this section of the code shall be guilty of a misdemeanor and/or be subject to a fine of up to two hundred and fifty dollars.

Mount St. Mary's Freshman Orientation Event

On August 20th, we successfully welcomed the incoming freshmen class from Mount St. Mary's to Emmitsburg. Orientation took place at Myers Park and our Community Pool mid afternoon. We're happy to have you all. Special thanks to Wendy Brubaker and those that helped in this assimilation process. Mayor Don Briggs and President Timothy Trainor, Mount St. Mary's University were present at the event.

St. Euphemia School Wayside Exhibit

Thank you to everyone who came out on August 10th to celebrate the St. Euphemia School wayside exhibit ribbon cutting on DePaul Street. This exhibit is one of 14 that will be part of a historic walking tour in Emmitsburg thanks to grant funding from the Heart of the Civil War Heritage Area.

Congratulations Sr. Anne M. Higgins!

Mayor Don Briggs presenting a proclamation to Sr. Anne M. Higgins, honoring her as the Town of Emmitsburg Poet Laureate (August 2022-August 2024) 

Sister Anne, is member of the Daughters of Charity for now 44 years. Additionally she teaches at Mount Saint Mary’s University now going on 23 years. Nine books of her poetry have been published: At the Year's Elbow ( Mellen Poetry Press 2000), Scattered Showers in a Clear Sky (Plain View Press 2007), Pick It Up and Read (Finishing Line Press 2008), How the Hand Behaves(Finishing Line Press 2009), Digging for God ( Wipf & Stock/Resource Publications 2010), Vexed Questions (Aldrich Press 2013), Reconnaissance (Texture Press 2014),  Life List(Finishing Line Press 2016) and  Not Only/But Also( Duck Lake Press 2019).  More than 100 of her poems have appeared in journals and magazines, and they have  been featured several times on The Writer's Almanac. She has given readings at the Curious Iguana Bookstore in Frederick, the Joaquin Miller Cabin and at Café Muse in Washington DC., and other venues on the East Coast.

Her hobbies are gardening and birding.

The Emmitsburg Trails: Local Youth Mountain Bike Racing

In an interstate match-up, the Monocacy Composite and Adams County Composite Youth Mountain Bike Teams will face-off at the Emmitsburg Trails. These two NICA powerhouses meet on Saturday, August 6. The first group rolls at 8:30 am, with two more groups following at 9am and 11am. This event is free to the public and always a crowd pleaser.

        A. This policy would modernize the Town’s parking meter fees, permits, and fines, which have not been reviewed since 2018. Meter bag permits and parking meter fees would gradually be increased from 01/2023 – 01/2027 in order to help fund various parking upgrades throughout the Town. An updated five-year parking plan will be presented to the Board.
5. Approval of Ordinance 2022-02, update to Title 10 – Parking for consideration.
       A. This ordinance would modernize the Town’s Vehicles & Traffic Code in order to allow parking meter fees, meter bag fees, and parking fines to be paid by credit card via a third party vendor. It would change the parking meter hours of operation to 8am – 8pm Monday through Saturday. Parking boots would be allowed to be utilized. Fines are moved from ordinance to policy.
6. Approval of Ordinance 2022-04, collection of municipal charges for consideration.
      A. This ordinance would allow any valid charges, taxes, or assessments issued by or on behalf of the Town, in addition to real estate taxes, be charged as liens upon the real property of the debtor within the municipality.  Such liens shall be able to be collected in the same manner as municipal taxes are collected. 
7. Approval of deed of easement for the Emmitsburg East Industrial Park II for consideration.
       A. The project’s landscape, snow storage, utility, storm water management, forest conservation, sewer abandonment, and stream buffer easements will be accepted by the Town as a requirement of development.  The long term forest conservation agreement will also be approved.

The Mayor and Board of Commissioners are pleased to announce that the Town of Emmitsburg has been awarded a Green Streets, Green Jobs, Green Town’s grant in the amount of $121,400.00 from the United States Environmental Protection Agency Region 3 and the Chesapeake Bay Trust.  This funding will be used in order reconstruct the existing dry extended detention pond through the installation of a sediment trapping forebay and micropool.  With this project, we will:

  1. Implement water quality controls capable of treating 7.96 acres of impervious area to address nutrient loading into the nearby Upper Monocacy River (with eventual drainage into the Chesapeake Bay). The proposed improvements will remove 57.94 lbs/year of nitrogen, 9.47 lbs/yr of phosphorus, and 14.51 tons/yr of total suspended solids. 
  2. Increase water quantity controls in anticipation of increased storm frequencies and intensities without increasing discharge flows.
  3. Create an aquatic and wetland fringe habitat within the existing footprint of the dry extended detention pond.
  4. Improve the biodiversity of the stormwater management feature through comprehensive planting and maintenance plans.

This project is necessary in order for the Town to meet its mandatory requirements under the federal Clean Water Act to improve water quality in Maryland’s streams, rivers, and the Chesapeake Bay.

Please be careful when traveling on North Seton Avenue as there may be delays and flaggers will be present.

Hiring Sewer/Water Operator Trainee

(We are willing to train the right person if no experience)

The Sewer/Water Operator Trainee is responsible for performing the daily operation and maintenance of the Town of Emmitsburg’s water and wastewater plants within the parameters of the Safe Drinking Water Act and state, and local regulations, including all systems, equipment, grounds equipment, laboratory equipment, and vehicles. Operator Trainees work with a Sewer/Water Operator or Lead Operator. This is a great opportunity to start your career in this field and learn from experienced team members.

WORK SCHEDULE: Monday thru Friday, 7:30 a.m. – 4:00 p.m. (On-call when needed)

ESSENTIAL DUTIES AND RESPONSIBILITIES:

  • Works with an Operator or Lead Operator in the performance of all requirements for the daily operation of the Town’s water/wastewater plants according to the procedures set by the Town, and in compliance with state and federal regulations.
Performs daily water treatment facilities maintenance and operation within NPDES permit limits, and accurately records required data in the Daily Log Book.
  • Complies with all safety and plant operation/maintenance procedures. Satisfactory and current compliance with workplace/job specific safety requirements, training and certification.
  • Performs necessary maintenance and repairs on tools, equipment, facilities, supplies and ensures vehicles are maintained and in good repair. Ensures that necessary repairs and general maintenance information are reported to the Lead Operator.
  • Assists Operator or Lead Operator with required weekly plant/facility tests.
  • Assists Operator or Lead Operator with the weekly inventory of all supplies, including laboratory and chemical supplies.
  • Assists PW crews with other Town maintenance work as needed, including emergency response, and at any time that additional crew is needed to perform seasonal and emergency grounds and road maintenance/repair, snow removal, grass mowing (manual and machine), weeding, and road repair for Town property.

KNOWLEDGE, SKILLS AND ABILITIES:

Education/Work Experience: High School graduate or equivalent preferred.

Certification/License:
– Valid driver’s license required. Ability/willingness to obtain CDL and Flaggers License within six (6) mos. of hire.
– Ability/willingness to obtain Water Treatment and/or Wastewater license to be eligible for promotion to S/W Operator.
– Must meet the Town’s requirement for satisfactory background check and drug screen.

Job Skills/Abilities:
- Skills/ability to learn the procedures and requirements for water/wastewater plant operation/maintenance and applicable regulatory and safety procedures, proper use of tools/equipment, chemicals and laboratory specs.
- Plumbing and electrical experience.
- Ability to perform job with minimal supervision; good problem identification and solving skills; reliable project/task follow-through; reliable work ethic.
- Good verbal/written communication skills; legible handwriting; good math ability (including metrics system).
- Willingness and availability to work varied shift schedule, including weekends, nights, early mornings, holidays and overtime.

Physical Requirements:
- Extensive walking and use of arms/legs for plant and grounds maintenance work, shoveling, mowing, weeding, hauling, lifting, climbing stairs, ladders, platforms, etc.
- Good eyesight and ability to clearly read equipment instrument panel digital input/output and discern applicable color codes, etc.
- Must be able to lift/carry 80 lbs.
- Must be willing/able to complete Hepatitis Shot (3-Series).
- Must be willing and able to perform interior/exterior work in all seasonal climate/weather conditions - rain, snow, sleet, hot, humid, cold, etc.
Job Type: Full-time
Pay: $15.26 - $19.83 per hour

Roughly 50 volunteers came out to plant 500 tree saplings Saturday morning along Creamery Road near Toms Creek. Local nonprofit Stream-Link Education organized the planting!

Power Outage 02/17/2022

The Town is aware of the power outages throughout Town. There are two poles down in the area of Frailey Road, Annandale Road and Mountain View Road. Estimated outage time is unknown as the power company has a one hour response time. Please use caution.

Stormwater Advisory Committee Update

In 2018, Emmitsburg was issued a Municipal Separate Storm Sewer System (MS4) Permit by the Maryland Department of the Environment to manage stormwater runoff. This requires the implementation of six minimum control measures, as well as treating stormwater from 20% of the Town’s impervious surfaces through best management practices (BMPs). The permitting cycle is continuous and permanent. After this permit term (2018-2023), new permits will be issued every five years. This is an expensive unfunded mandate, and it is estimated that the impervious surface restoration requirement alone will cost the Town over $700,000 during this permitting cycle. Since the permit will continue indefinitely, the Town is considering ways to fund future MS4 projects. Emmitsburg has formed a Stormwater Advisory Committee and the Board of Commissioners has engaged the University of Maryland’s Environmental Finance Center (EFC) to conduct a stormwater financing feasibility study. Through a series of four public meetings, EFC will present the Advisory Committee with information about potential financing options to help determine the most equitable way to fund the Town's stormwater program.

          1. Stormwater Utility Feasibility Study presentation and final recommendation – presentation by staff and the University of Maryland

The Town has received a zoning map amendment application for Lots C and D as shown on the Final Plat of Section 1 – Plat 1 Parcels “C”, “D” & “E” of Brookfield recorded in Plat Book No. 58, Page 40.  These lots are located at the entrance of the Brookfield residential development.  The application is being presented to the Planning Commission on March 28th at 7:00 PM.  It will go to the Board of Commissioner’s with the Planning Commission’s recommendation at a scheduled Public Hearing on April 4th at 7:30PM.  Final vote is scheduled for April 4th.
